9. RIGHT OF RETURNING A PRODUCT
You can return a product and get refunded for the full price, if you notify us in writing through our contact pages, with your decision within 14 calendar days of receipt of the product by you or any third party you will indicate. If you order many products at once, the consignment period starts the moment you receive the latest product. Finally, in cases of digital content that is not stored and is downloadable or service provided, the date starts from the date of conclusion of the contract (checkout).
In case of order cancellation, you are obliged to return the product in perfect condition as delivered to you or deliver us clear and not debatable evidence that you have certainly sent it back within 14 calendar days from the exercise of returning (withdrawal) right by you and by the same deadline, we are obliged to refund you any net amounts you paid us.
In each case the products you wish to return must be accompanied by the necessary documentation and receipts. Shipping costs for returning the product are not covered by PROMiS Media and are charged to the client. Refund from PROMiS Media does not include the shipping costs to you, but only the net amount of the purchase.
No withdrawal is entitled in respect of the Article 3l of L.2251 / 94 and in any other case provided by law or according to the law. Indicatively, you are not entitled to exercise withdrawal on products like headphones, plasticine for hygienic reasons, the supply of sealed audio or sealed video recordings or sealed computer software which were unsealed after delivery and supply of digital content not supplied on a tangible medium if the implementation began with the prior express consent of the consumer and his acknowledgment that thus loses the right of withdrawal.
10. WARRANTY AND SUPPLIER LIABILITY FOR DEFECTS
The producer of any products that you buy is responsible for any damage caused by a defect in his product. Each reduction or waiver agreement of the manufacturer from liability is void.
The claims against the manufacturer for defects are barred after three years have passed since the buyer has discovered or should have been aware of the damage, the defect and the identity of the producer. If not, then the buyer can request cancellation of the contract.
If the required repair time is exceeding fifteen (15) business days, the consumer is entitled to request the temporary replacement of the product for the duration of the repair, but only if there is relative ability of the Supplier. The breach of the part of the Supplier of the service shall not affect the validity of the guarantee, which the consumer may invoke and require the supplier to be honored. If there is replacement of the product or replacement of any part, the comprehensive guarantee is not renewed over to the old product but only for it the new product.
Beyond the warranty, the Supplier of new consumer durables must allow consumers have a continuous supply of them for maintenance and repair of technical services for a period equivalent to the probable duration of their life.
Supplier must also allow consumers a free supply of spare parts and any other products required for their use in accordance with their intended purpose, for all the probable duration of their life.
In pursuance of the above provisions, as long PROMiS Media is a Supplier of a product as defined above, will provide all possible assistance for the fulfillment of the conditions of the Supplier guarantee at no extra cost. This is done separately from any warranty maintenance services, which the company can be providing occasionally with the applicable charges.
Finally, PROMiS Media is obligated to obey in the Civil Code for the sellers rights. Especially in case of a defect of the product the company sells, you can (a) require it to be repaired without any extra costs or be replaced with another unless this is impossible or requires a disproportionate expenditure (b) to ask for a price reduction if possible, and (c) to withdraw, unless it is a minor defect.
These obligations do not exist if the defect is caused by you, or in the narrow or broad sense majeure. In each case the products must be accompanied by the necessary documentation and receipts, which apply to cover Contracts Warranty Extension and are not transferred from buyer to buyer. These obligations in any event barred within two years unless otherwise indicate by PROMiS Media.
11. ORDER CANCELLATION
